General Terms and Conditions

§ 1 Scope of Application

1.1 These General Terms and Conditions for the Hotel Industry ("AGBH 2006") replace the previous Austrian Hotel Contract Conditions.

1.2 Special agreements remain unaffected. Individual agreements take precedence over these terms and conditions.

§ 2 Definitions

Accommodation Provider: A natural or legal person providing accommodation against payment.

Guest: A natural person making use of accommodation services.

Contracting Party: A person who enters into an accommodation agreement for themselves or another guest.

Consumer / Entrepreneur: As defined under applicable Austrian consumer protection legislation.

Accommodation Agreement: The contract concluded between the accommodation provider and the contracting party.

§ 3 Conclusion of Contract and Deposit

3.1 The accommodation contract is concluded once the booking is accepted.

3.2 The accommodation provider may require a deposit.

3.3 Any requested deposit must be paid within 7 days of booking and no later than 48 hours before arrival.

3.4 The deposit shall be credited against the agreed accommodation price.

§ 4 Beginning and End of Accommodation

4.1 Rooms are available from 4:00 PM on the agreed arrival date.

4.2 Early use of the room before 10:00 AM may be charged as an additional overnight stay.

4.3 Rooms must be vacated by 11:00 AM on the day of departure. The accommodation provider may charge an additional day if the room is not vacated in time.

§ 5 Cancellation of the Accommodation Contract

5.1 If a required deposit is not paid in due time, the accommodation provider may withdraw from the contract.

5.2 If a guest does not arrive by 6:00 PM on the arrival date and no later arrival has been agreed, the accommodation obligation expires.

5.3 Paid reservations remain valid according to the agreed reservation period.

5.4 The accommodation provider may cancel the agreement for objectively justified reasons.

5.5 Guests may cancel free of charge within the agreed cancellation period.

5.6 Outside this period, the cancellation fees stated in the booked rate apply.

5.7 In cases of extraordinary circumstances preventing arrival, such as severe weather or force majeure, statutory provisions apply.

§ 6 Alternative Accommodation

6.1 The accommodation provider may offer equivalent alternative accommodation if necessary and reasonable.

6.2 Typical reasons include unavoidable operational circumstances or overbooking.

6.3 Additional costs are borne by the accommodation provider.

§ 7 Rights of the Contracting Party

7.1 Guests are entitled to the normal use of booked rooms and facilities in accordance with house rules.

§ 8 Obligations of the Contracting Party

8.1 Guests are obliged to pay all agreed charges by departure.

8.2 Additional transaction or currency conversion costs may be charged.

8.3 Guests are liable for damages caused by themselves or accompanying persons.

§ 9 Rights of the Accommodation Provider

9.1 The accommodation provider may exercise legal retention and lien rights permitted by Austrian law.

9.2 Special services may be charged separately.

9.3 Interim billing may be issued at any time.

§ 10 Obligations of the Accommodation Provider

10.1 Agreed services will be provided according to the standard of the establishment.

10.2 Additional chargeable services may include:

• Private sauna reservations outside standard opening hours
• Additional beds and children's beds
• Other optional services not included in the room rate

The Panorama Swiss Pine Sauna is available free of charge to overnight guests daily from 6:00 PM to 9:00 PM.

§ 11 Liability for Guests' Property

Liability for guests' belongings is governed by Austrian law. Claims are limited to the extent legally permitted.

§ 12 Limitation of Liability

Liability limitations apply in accordance with Austrian law and the distinction between consumers and business customers.

§ 13 Pets

13.1 Dogs are only permitted with prior registration and approval.

13.2 A cleaning fee per room and stay will be charged.

13.3 Dog owners are responsible for supervising their animals.

13.4 Guests must hold adequate liability insurance.

13.5 Guests are liable for damages caused by their animals.

13.6 Dogs are not allowed in wellness areas.

§ 14 Extension of Stay

Guests have no automatic right to extend their stay. Extensions depend upon availability.

§ 15 Termination of Accommodation Agreement

The accommodation agreement ends on the agreed departure date unless terminated earlier according to these terms or applicable law.

§ 16 Illness or Death of a Guest

In emergencies the accommodation provider may arrange medical assistance. Associated costs remain the responsibility of the guest or their legal successors where permitted by law.

§ 17 Governing Law and Jurisdiction

The agreement is governed by Austrian law.

The place of performance is the location of the accommodation provider.

Jurisdiction shall be determined in accordance with applicable Austrian and European consumer protection regulations.

§ 18 Miscellaneous

Should any provision of these terms be invalid or unenforceable, the remaining provisions remain unaffected.

Any matters not specifically regulated shall be governed by applicable Austrian law.
